Hooray! Lafayette & Kumagai successfully defended a Fortune 50 company in a jury trial in the United States District Court for the Northern District Of California where Plaintiff claimed Defendant failed to reasonably accommodate her disability, failed to engage in the interactive process in good faith in violation of the California Fair Employment and Housing Act, harassed her because of her disability, and then terminated her because of her disability. Plaintiff also claimed Defendant failed to take steps to prevent discrimination. Plaintiff sought back pay, future pay until the age of her retirement, and damages for emotional distress. Defendant denied all claims. The jury reached a unanimous verdict on September 26, 2018 against Plaintiff after deliberating for approximately 12 hours. Individuals participating in the effort on behalf of the employer defendant included, Susan Kumagai, Kelvin Su, Trinh Ngo, Gary Lafayette, and a host of individuals from the employer who took time to testify in the case.
