Kudos to Brian Chun and Gary Lafayette! The California Court of Appeal affirmed the Superior Court’s grant of summary judgment for Lafayette & Kumagai’s clients, a Fortune 50 company and an individual defendant. In his underlying case, Plaintiff alleged discrimination based on his race and national origin, defamation, intentional infliction of emotional distress and wrongful termination. In granting summary judgment for Defendants, the Yolo County Superior Court found that Defendants provided a legitimate, non-discriminatory reason for Plaintiff’s termination and that Plaintiff failed to establish the elements of his defamation cause of action against Defendants.
